This Privacy Policy is issued by Flogal Holdings LLC, an Oklahoma limited liability company ("Flogal," "we," "us"), on its own behalf and on behalf of Flogal Leasing LLC and Flogal Properties LLC, in each case with respect to that company's own collection and use of personal information.
Each Flogal company is a separate legal entity. This policy is published as a single document for the reader's convenience. It does not create, and may not be construed as evidence of, any agency, partnership, joint venture, common enterprise, or joint or several liability among them. Where this policy says "Flogal," it means the entity that collected your information. If you want to know which entity holds information about you, contact us and we will tell you.

(a) Our public websites: flogalhq.com, carriers.flogalhq.com, sales.flogalhq.com, and properties.flogalhq.com.
(b) Flogal Apps (apps.flogalhq.com and the Flogal Apps mobile application), our internal operations platform. Flogal Holdings LLC operates the platform for its own personnel and administers it on behalf of affiliated companies that use it.
(c) Services to other businesses. We may provide technology, administrative, implementation, evaluation, or related services to other businesses. When another business authorizes us to operate or evaluate systems on its behalf, we may process information relating to that business, its operations, and its personnel as necessary to provide those services. In those circumstances, that business remains responsible for its own information and may provide its own notices or policies concerning it.
This policy does not cover information governed by a separate written agreement between Flogal and a customer, vendor, or other organization, except where that agreement says otherwise.
From visitors to our websites. What you submit through a contact, quote, or inquiry form — name, company, email address, phone number, and the contents of your message — and standard technical information your browser sends, such as IP address, browser type, and pages visited.
Website analytics. We use a cookieless analytics service provided by our website host to understand how our websites are used, such as how many people visit, which pages they view, which site referred them, their general location (country, state, city), and their device and browser type. It does not use cookies, does not track you across other websites, and gives us aggregate statistics only. We do not use it to identify you. We do not use advertising trackers, advertising pixels, or session-recording tools. Because we do not track visitors across websites, we do not respond differently to browser Do Not Track signals.
From customers, vendors, and business contacts. Contact details for the people we do business with, and records of loads, shipments, equipment, properties, invoices, payments, and related correspondence.
Phone calls. We may record phone calls with you for quality, training, and record-keeping. If a call is recorded, we will tell you at the start of the call.
From employees, contractors, and drivers using Flogal Apps. Account and login records; name, contact details, date of birth, and emergency contact information; employment and tax documents you complete or we generate — including Form I-9, Form W-4, offer letters, and separation documents — which contain your Social Security number and other identifying information; driver's license and commercial driver's license information, motor vehicle records, and medical examiner's certificates; safety and employment history obtained through the FMCSA Pre-Employment Screening Program and Drug and Alcohol Clearinghouse; drug and alcohol testing records; onboarding, orientation, training-completion, qualification, and work-related records; a driver safety score derived from telematics safety events, with its history over time; photographs of delivery tickets, receipts, and vehicle conditions that you upload; load counts, tonnage, and related work records; pay and payroll-supporting records; inspection reports, repair requests, maintenance, parts, and task records that you enter; and account and activity records generated by your use of the platform.
Employment, tax, screening, and testing documents are stored in restricted storage and are accessible only to personnel whose role requires it.
From vehicles and equipment. Telematics data from devices installed in company-owned vehicles, described in Section 7.
Our websites and platform are not directed to children, and we do not knowingly collect personal information from children under 13.
To respond to inquiries and quote requests; to provide and document transportation, equipment, leasing, and property services; to operate Flogal Apps, including dispatch, ticketing, payroll, maintenance, and reporting; to maintain safety, DOT, and regulatory compliance records; to manage insurance and claims; to secure our systems and investigate misuse; to provide services to other businesses that have authorized us to do so; and to meet our legal, tax, and contractual obligations.
We send text messages only to people who have given us prior express consent, obtained verbally, in person, or by checking the optional text-message box on one of our forms. Consent is never required to do business with us. Our program is conversational and customer-care messaging only. We do not send marketing or promotional text messages. Full terms, including how we obtain consent and how to withdraw it, are in our SMS Terms.
We do not sell mobile phone numbers or text-messaging consent information, and we do not share them with third parties or affiliates for marketing or promotional purposes. Mobile numbers and consent records are processed by our telecommunications and messaging service providers only as needed to deliver messages and maintain records.
We do not sell personal information, and we do not share it with third parties for their own marketing purposes.
Service providers. Providers that process information on our behalf and only as needed to provide their service: cloud hosting, database, and file storage; email, document, and productivity services; vehicle telematics; accounting and payroll; banks and payment processors; telecommunications and messaging; and background screening, motor vehicle record, and drug and alcohol testing program administrators.
In the course of the work. Customers, shippers, brokers, consignees, and their agents, as necessary to schedule, perform, document, and bill the work — including driver name, unit, and delivery information.
Where required or appropriate. Professional advisors such as attorneys and accountants; insurance brokers, insurers, and their adjusters in connection with coverage or a claim; factoring companies and collection agencies in connection with receivables; regulators and law enforcement where the law requires; and a counterparty, and its advisors, in connection with a financing, acquisition, sale, or reorganization of all or part of a business, subject to confidentiality.
Other businesses we serve. When we process information on behalf of another business under Section 2(c), we share it with that business and as that business directs.
Records with special protection. Drug and alcohol testing records are maintained and released only as permitted by the U.S. Department of Transportation's rules at 49 C.F.R. Part 40, which generally require your specific written consent before release to anyone other than your employer, the testing program, or a regulator. Consumer reports obtained for employment purposes are handled under the Fair Credit Reporting Act. Nothing in this policy authorizes a disclosure those rules prohibit.
Company-owned vehicles are equipped with telematics devices and, on some units, cameras. Depending on the equipment installed and enabled, these systems may record vehicle location, mileage, fuel and engine data, diagnostic faults, inspection reports, driving behavior, safety events, and video and related recordings. Some of this information is displayed in Flogal Apps.
We use telematics information for dispatch, safety, maintenance, regulatory compliance, incident investigation, insurance and claims, and customer billing. Access is limited to personnel and service providers whose duties require it, which may include management, safety, maintenance, human resources, and platform administration.
Vehicles are equipped with road-facing and driver-facing cameras, and some may have additional exterior cameras. Our cameras do not record audio. Authorized personnel may view camera feeds live while a vehicle is in operation. Vehicles may be taken home by drivers in some circumstances; devices and cameras continue to record whenever the vehicle is in operation. Flogal Apps stores a safety score for each driver derived from telematics safety events, with its history over time.
Our camera system does not use facial recognition or other biometric identification.
Employees and drivers receive a separate Workforce Telematics & Monitoring Notice with additional detail.
For as long as needed for the purpose it was collected and as long as the law requires. Payroll, tax, DOT, safety, and drug and alcohol testing records are kept for the periods those regulations require. Records of consent to receive text messages, and of its withdrawal, are kept for at least five years after our last message to that number. Delivery tickets, load records, and maintenance records are kept for the life of the business relationship and any applicable limitations period. Information we hold on behalf of another business is kept as that business directs and as our agreement with it requires.
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
You may withdraw consent to receive text messages at any time, by any reasonable means — see Section 6 of our SMS Terms.
Where the law gives you a right to access, correct, delete, or obtain a copy of personal information we hold about you, you may make a request using the contact details in Section 1, and we will respond as the law requires. We will take reasonable steps to verify your identity first. Federal and state transportation, tax, employment, and safety rules require us to retain certain records, and we will tell you if that applies.
If you are an employee, contractor, or driver, information processed in the employment context is governed by your employment or engagement terms and company policy. Flogal Apps users may request account closure as described in our Account Deletion page.
We may update this policy. The version number and effective date at the top show when it last changed, and we keep prior versions on file. If a change materially affects how we handle your information, we will post the updated policy here before it takes effect and, if you use Flogal Apps, ask you to review it.
